Mary Mubaiwa, former wife of Zimbabwe’s Vice-President Constantino Chiwenga, is seeking a permanent halt to her attempted murder prosecution. Mubaiwa is accused of trying to disconnect Chiwenga’s life support in South Africa.
Her lawyer, Beatrice Mtetwa, filed the application, arguing that delays in the case make a continued trial unjust. Mtetwa stated the prosecution’s delay has made the legal proceedings unfair.
The application, submitted under Case No. ACC 95/19, requests a permanent stay of prosecution. This rare measure aims to stop further trial processes indefinitely, with Mubaiwa’s health cited as a key reason.
According to the court application, Mubaiwa’s health has significantly declined, raising concerns about her capacity to endure the strain of the ongoing criminal case. Mtetwa argued that further prosecution would be unjust given her health condition.
The trial has seen numerous delays. Recently, the State sought a postponement to examine Mubaiwa’s application for permanent suspension. Magistrate Feresi Chakanyuka deferred the decision until November 22.
During prior hearings, Dr. John Mangwiro, former Deputy Health Minister, testified about Chiwenga’s hospitalization. Mangwiro’s testimony detailed suspicious changes in Chiwenga’s condition around Mubaiwa, complicating the case further.
Dr. Mangwiro recounted moments when Mubaiwa allegedly resisted bringing Chiwenga to the hospital, instead proposing alternative options, such as a hotel stay. He warned of health risks associated with her insistence on these unconventional choices.
The case has generated significant public interest due to the high-profile individuals involved. All eyes are now on the court’s impending decision regarding Mubaiwa’s application, which could alter the case’s course entirely.
